Terms of Use — Biu Note

These Terms of Use ("Terms") govern your use of the Biu Note application ("app", "service"), operated by IAGO BELO DE OLIVEIRA VIEIRA DESENVOLVIMENTO DE SOFTWARE, CNPJ 38.009.261/0001-45 ("we"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the service.

The service

Biu Note is a note-capture application that organizes, summarizes, and indexes your content (text, links, and images) with the help of artificial intelligence. The service is available as a mobile app (iOS/Android) and on the web.

Account

• You need an account (authenticated via Clerk) to use the app.
• You are responsible for maintaining the confidentiality of your account access and for all activity carried out under it.
• You must have the legal capacity to accept these Terms.

Plans and billing

• Free plan: unlimited note capture. AI enrichment (classification, summaries, OCR, semantic search) is limited to the first 10 notes per month; beyond that limit, your notes continue to be saved normally, just without AI processing for that month.
• Pro plan: unlimited AI enrichment, plus unlimited capture.
• The details, pricing, and method of subscribing to the Pro plan are presented within the app at the time of purchase and are processed by the app stores (App Store / Google Play), subject to their respective terms.
• You may use the free plan indefinitely, with no obligation to subscribe.

Your content

• You retain all rights over the content you capture (notes, images, links).
• You grant us a limited licence to store and process that content solely to operate the service (including sending it to AI providers when AI processing is enabled). Data handling is detailed in the Privacy Policy.
• You can disable AI processing at any time in the app settings.
• You are solely responsible for the content you capture and must have the right to use it.

Acceptable use

You agree not to use the service to:

• Violate laws or the rights of others (including intellectual property and privacy).
• Store or distribute illegal, abusive, or harmful content.
• Attempt to compromise, overload, or gain unauthorized access to the service infrastructure.
• Reverse engineer or resell the service without authorisation.

We may suspend or terminate accounts that violate these rules.

Availability and changes

• The service is provided "as is", without guarantee of uninterrupted availability.
• We may modify, suspend, or discontinue features at any time.
• AI features depend on third-party providers and may vary in quality, availability, and output; we do not guarantee the accuracy of AI-generated content.

Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, or consequential damages arising from the use or inability to use the service, or for data loss. Please back up important content.

Termination

• You may terminate your account at any time through the app (Settings → Delete account), which initiates deletion of your data as described in the Privacy Policy.
• We may terminate or suspend your access in the event of a breach of these Terms.

Changes to the Terms

We may update these Terms periodically. Material changes will be indicated by the "Last updated" date above. Continued use after changes constitutes acceptance.

Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes shall be submitted to the courts of the user's domicile, in accordance with the Brazilian Consumer Protection Code.
